1. As a matter of law, a charge of attempted domestic abuse murder cannot lie because specific intent, which is required for an attempted crime pursuant to Minn. Stat. § 609.17 (1996), is not an element of the offense of domestic abuse murder under Minn. Stat. § 609.185(6) (1996). 2. To sustain a conviction for pattern harassment, Minn. Stat. § 609.749, subd. 5 (1996), the state must prove beyond a reasonable doubt each element of pattern harassment, including elements of the underlying crimes.
